Terms of Service
Last updated: 22 September 2026
These terms govern the use of the Nearoo app for Android and of the linked pages of the www.djo2.it website. By installing the app and accessing the service you accept the following. If you do not agree, do not use Nearoo: you can uninstall the app and ask for the deletion of the account at any time. For the processing of personal data the Privacy Policy applies, which forms part of these terms.
1. Who we are and what the service is
Nearoo is a proximity social app distributed by Cristian (Nearoo project, powered by DJO2) through the www.djo2.it website. The service lets you see how many people are near you and at what distance, exchange messages with them (chat and Smoke Signals) and manage your profile and your visibility settings. The app is free and contains no advertising; it has no subscriptions.
The service is provided "as is": we can add, change or remove functions, and we can suspend the provision for maintenance or for technical and security reasons.
2. Age requirements
Nearoo is reserved exclusively for people over 18 years of age. By confirming that you are at least 18 years old you declare that you meet this requirement and you take responsibility for what you declare. If we become aware of an account managed by a person of a lower age, we disable it and delete the linked data.
3. Your account
- You sign in with a Google account: we do not manage passwords of our own and we never ask your password to anyone, in any way.
- The information of the profile (name, photo) must be truthful and must not impersonate other people, companies or bodies.
- One account per person: using multiple accounts to get around blocks, limits or moderation measures is prohibited and leads to the closure of the accounts.
- You are responsible for the use of your device: whoever uses it accesses your account. Keep the protections of the phone up to date (screen lock, system updates).
- You can delete the account whenever you want, from the app (Profile, Delete account) or from the website (deletion request).
4. Location, radar and privacy
- To work, Nearoo needs your location, also in the background, and shows you the people nearby in real time. You grant the permission on the first launch and you can revoke it whenever you want from the Android settings.
- Your exact location is never shown to the other users. Before leaving the server, the location is moved to a random point of the privacy ring of 70-500 metres, with a stable value linked to your account: the same person always appears in the same obfuscated point and the distance shown never drops below 70 metres.
- You can hide from the settings: while it is active you do not appear on anybody's radar, while you keep using chat and Smoke Signals.
- We do not ask for nor manage the location of people who do not use the app, and we will not allow the use of the service to surveil somebody: it is prohibited, and it leads to the closure of the account.
5. Rules of conduct and content
Nearoo puts in contact people who do not know each other: the behaviour of everyone is the most important part of the service. It is prohibited, among other things, to:
- harass, threaten, insult, discriminate against or stalk other users, also in an insistent way after a refusal or a block;
- publish or send illegal, violent or unsolicited sexually explicit content, child sexual abuse material, content that incites hatred or that concerns unlawful activities;
- use photos or names of other people, or images you have no right to use;
- pretend to be a minor or to be an adult if you are not, and in general declare something false about your identity or age;
- do spam, advertising, propaganda, chain messages, fundraising or unauthorised campaigns, and use the Smoke Signals for commercial purposes;
- spread personal data of third parties (phone numbers, addresses, documents, photos) without their consent, or try to reconstruct the real location of another user;
- prostitution, grooming, sale of substances or of any unlawful good or service;
- use bots, scripts, emulators, modified apps or scraping techniques to access the service or collect data of other users;
- try to get around the security measures, the blocks, the suspensions or the moderation systems.
The content you publish (photos, messages, voice messages) remains yours, but you are responsible for what you write and send: we do not check the content in advance, we verify it on report.
6. Reports, blocks and moderation
- Block: from the card of a user or from the chat you can block a person at any time, giving a reason. Blocked users cannot see you nor contact you.
- Report: you can report a profile or a conversation. Reports with content are examined also with the help of automatic text analysis tools (artificial intelligence) to give priority to the most serious cases: the final assessment and every measure remain our responsibility.
- Measures: depending on the seriousness we can warn, limit the visibility, suspend or close the account, without obligation of prior notice for the most serious cases (illegal content, danger for other users).
- Objections: if you believe that a measure is wrong you can write to us at the address given in point 12 and we review the case.
7. Safety when meeting in person
- Meet for the first time always in a public and crowded place, during the day, and tell a friend or a relative where you are and with whom.
- Do not meet in private homes, do not get into the car of a person you do not know, do not have someone pick you up at home.
- Do not share your home address, documents, banking data or other sensitive data before knowing the person; never send money, top-ups or codes.
- Be wary of whoever immediately asks to move the conversation to another app or asks you for money, investments, intimate photos or personal data: it is almost always a scam.
- If you feel in danger call 112 and, if you want, report the user immediately from the app.
8. Limitation of liability
- Nearoo does not verify the identity nor the reliability of those who use the service and is not responsible for the damages arising from meetings, conversations or interactions that took place through the app, nor for the content published by the users.
- The service is provided "as is" and "as available": we do not guarantee that it is always accessible, free of errors, nor that the location shown corresponds to the exact place where a person is (it is obfuscated by a privacy choice).
- We are not liable for interruptions due to maintenance, faults, problems of the network, of the device or of the technical providers, nor for a use of the app contrary to these terms or to the law.
- Nothing of what is written here limits the rights that the law recognises to consumers, nor our liability in case of wilful misconduct or gross negligence.
9. Suspension and closure of the account
You can close your account at any time (point 3) and nobody will prevent you from doing it. We can suspend or close an account, also without notice, if it violates these terms, if it creates a risk for other users or for the service, or if the law requires it of us. When an account is closed for a violation, the linked data are processed according to the privacy notice (they remain stored only for the time necessary to handle reports or obligations of the law). The right to challenge the decision by writing to the address in point 12 remains unaffected.
10. Intellectual property and user content
The name Nearoo, the logo, the graphics and the software of the app are protected by copyright law and cannot be copied, modified, decompiled or reused without written authorisation, except as allowed by the law.
The content you upload (photos, messages, voice messages) remains yours. With the sending you grant us only the technical, free and non-exclusive permission to store them and show them to those you must (the users of your range or the recipients of the conversations) and to make the service work. This permission ends when you delete the content or the account. You guarantee that you have the right to publish what you upload and not to violate the rights of third parties.
11. Changes, applicable law and jurisdiction
- Changes: we can update these terms for new functions, for the law or for security needs. The version in force is the one published on this page, with the last update date at the top; substantial changes are communicated also inside the app. By continuing to use Nearoo after the update you accept the new terms.
- Applicable law: these terms are governed by the Italian law.
- Jurisdiction: if you are a consumer, the court is that of your place of residence or domicile, as provided for by the Italian Consumer Code; in the other cases the competent court is that of the owner indicated in point 1.
- Dispute resolution: before any legal action we ask you to write to us at the address in point 12: in almost all cases a technical problem or a misunderstanding is solved this way, in a few days.
